Human rights lawyer, Inibehe Effiong, has sued the Chief Judge of Akwa Ibom State, Ekaette Obot, over her refusal to furnish him with his conviction order and copies of court proceedings, despite repeated applications.

The human rights lawyer filed a suit at the Federal High Court in Uyo, praying the court to direct Justice Obot to furnish him with a copy of the 27 July judgment.

Effiong also urged the court to declare as illegal and unconstitutional, the judge’s refusal to release the conviction order, as it violated Section 36 (7) of the 1999 Constitution as amended.

In a court document made available to The PUNCH by the counsel to the plaintiff, Femi Falana, it was noted that Effiong was entitled to a copy of the judgment within seven days of the conclusion of the case.

Effiong was remanded in prison on July 27 by Justice Obot, for alleged contempt of court.

He served the first two weeks of his 30 days sentence at the Ikot Ekpene Custodial Center of the Nigeria Correctional Service.

He was later transferred to Uyo Custodial Centre to serve the remaining days.

Clement Adedotun, the Uber driver who was assaulted by officials of the Lagos State Neighborhood Safety Corps (LNSC) and Nigeria Police Force during the first anniversary of the #EndSARS protest at the Lekki toll gate in the state on Wednesday, October 20, has demanded an N500 million compensation from the state government

In a letter written by his lawyer, Inibehe Effiong, Adedotun also demanded that disciplinary measures be taken against the men who assaulted him and that they should be prosecuted in court in line with the Anti-Torture Act and the Criminal Law of Lagos State. He is also demanding a written apology from the state government.

Inihebe in a statement released said Adedotun’s vehicle has been returned but in a bad condition. The letter stated that the agents of the state government broke and damaged the front windscreen of his Toyota Corolla. The vehicle was in good condition before it was towed away on Wednesday, October 20. But upon reaching where the vehicle was taken to on Friday, 22nd October 2021, Adedotun said he saw the destruction done to his vehicle by agents of the state government.

Inibehe said the implication is that Adedotun cannot use the vehicle to earn a living until it is repaired.

Reacting to news of the sanctions placed on the erring officers by the Lagos State Neighborhood Safety Agency (LNSA), Inibehe said ”while we commend the Lagos State Government for admitting that the conduct of its agents was criminal and unprofessional, we find the two months suspension meted on the two officers grossly insufficient and unacceptable. It is not a deterrence. The officers should be dismissed and diligently prosecuted in a court of law to serve as a deterrence to others.”

Inibehe said the Lagos State Government has 48 hours to give in to their demands or face legal action.

The Federal Government has denied claims that it has stopped Nigerians from using the microblogging site, Twitter.

The Attorney-General of the Federation, Abubakar Malami, and the Federal Government made the denial in a counter-affidavit they deposed to in response to an originating motion filed by human rights lawyer, Inibehe Effiong.

On June 4 2021, the Federal government announced the indefinite suspension of the operations of Twitter in Nigeria. The government suspended the site operations days after it deleted a Tweet from President Buhari’s handle in which he referred to the civil war which many found offensive. The Attorney General had released a statement threatening to prosecute Nigerians still using the platform via VPN while the National Broadcasting Commission ordered all radio and television stations to stop using Twitter or picking content from the platform.

Opposed to the move by the Federal government, HumanRights lawyer, Inihebe Effiong, dragged the Minister of Information, Lai Mohammed and the Federal government before the court. In a fundamental human rights suit marked FHC/L/CS/542/2021, Inihebe asked the court to amongst other things grant an order of perpetual injunction restraining the respondents from further suspending, deactivating, or banning the operation and accessibility of Twitter or any other social media service in Nigeria because the act violated his rights.

Effiong asked the court to declare as illegal the ‘threat of criminal prosecution by Malami and Lai Mohammed against Nigerians who violate the suspension or ban of Twitter, despite the absence of any written law.’

In an affidavit deposed to by Mr Ilop Lawrence on behalf of the Federal Government and Malami, it was stated that the suspension of Twitter was not an abuse of human rights because Nigerians were still using Twitter despite the suspension. The government told the court that Nigerians are still free to use platforms like WhatsApp, Facebook, Tiktok and others. The Federal Government also denied knowledge of Twitter deleting Buhari’s tweet on the Biafra civil which offended many Nigerians.

It said Twitter had made its platform accessible to elements like Nnamdi Kanu, the leader of the Indigenous People of Biafra; and had supported the #EndSARS protests of October 2020 which were later hijacked by hoodlums. The government further stated that Nigerians should direct their anger at Twitter and not the government because Twitter would not have been suspended if it complied with Nigeria’s laws. It told the court that the Twitter suspension would be lifted once the platform registers with the NBC and the Corporate Affairs Commission.

The affidavits deposed by the Federal government reads in part “The applicant (Effiong) and the class he seeks to represent can still operate those Twitter accounts from anywhere in the world and even from Nigeria. Nigerians are still tweeting, even at this moment as the ban on Twitter is not aimed at intimidating Nigerians or an infringement on the rights of Nigerians to express their opinion. The respondents (Federal Government and AGF) have never stopped the applicant (Effiong) and the class of persons he seeks to represent from voicing their opinions to access government information and offer criticism where necessary.”

A journalist, Ayoola Babalola, has been allegedly arrested by officials of the Department of State Services.

It is said that he was arrested for allegedly publishing articles criticising President Buhari’s administration and also the national leader of the All Progressives Congress, Bola Tinubu as well as the EFCC.

Human rights lawyer, Inibehe Effiong, who is the legal representative of Babalola, made this known in a statement he released on social media.

Late on Friday, 24th January, 2020, I was alerted that my client Mr. Ayoola Babalola, a courageous student activist and young journalist, was arrested and charged to court for allegedly publishing certain articles in a Campus Newspaper called GAPOSA Trumpet in which he served as the Editor. Babalola recently graduated from the Gateway Polytechnic located in Sapaade, Ogun State, where he read Mass Communication.
The said articles which were deemed critical of President Buhari, APC Leader, Sen. Bola Ahmed Tinubu and the EFCC also led to the dismissal of a lecturer of Gateway Polytechnic who served as the Producer of the campus newspaper. He was arrested on Thursday in Abeokua by the State Security Service (SSS) and taken before a Magistrate Court on Friday. His appeal to the SSS for him to be allowed to contact me as his counsel was rebuffed. Mr. Babalola was only able to contact me through a third party from the Ibara Maximum Prison in Abeokua where he was remanded by the court. I understand that he was arraigned on a six count charge bothering on alleged incitement, conduct likely to cause a breach of the peace and so on for allegedly publishing critical articles against President Buhari. The said articles also related to the travails of the leader of the RevolutionNow movement, Mr Omoyele Sowore, and student activist, Comrade Femi Adeyeye. Before his secret arrest and arraignment, Mr. Ayoola briefed me over repressive actions which he believed Gateway Polytechnic may likely take against him over the articles that he published. Mr. Babalola also intimated me that the SSS were possibly trailing him because of the said articles. I condemn this despotic and needless actions by the SSS. It is a shame that at a time the country is battling serious security challenges, the SSS rather than protect Nigeria, is paranoid about any form of criticism against the Buhari regime. The SSS has continued to expose the country to public and international ridicule over its flagrant violation of the rights of Nigerians and shameless disregard for the rule of law and democratic ethos. The SSS will not be allowed to turn Nigeria into a police state. We will face them squarely in court. All legal options will be explored to secure the release of Babalola and safeguard his legal and constitutional rights. Tyranny will not win.
